Fishing drill pipe sheared in error.

Taking a hypethetical case of being 8m off bottom and the driller shuts the shear rams in error on 5 inch pipe. Not thinking about correct spacing out the cut is 1.5m above the pipe tool joint.

What would be the procedure to fish the drill string.?

Seems to me issues would be;
Lack of weight to apply to mill.
Profile offered up by sheared pipe very irregular.
Proximity of top of fish to BOP stack....
etc, etc.........................
